An act to amend Section 20104.6 of the Public Contract Code, relating to public contracts.

AB 1625, as introduced, Hart. Public contracts: payment.
Existing law, the Local Agency Public Construction Act, sets forth the requirements for competitive bidding on various types of contracts awarded by local agencies. That act requires local agencies to pay undisputed portions of specified public works claims for payment, except as otherwise provided for in the contract.
This bill would make a nonsubstantive change to that provision.

The people of the State of California do enact as follows:


SECTION 1.

 Section 20104.6 of the Public Contract Code is amended to read:

20104.6.
 (a) No A local agency shall not fail to pay money as to any portion of a claim which that is undisputed except as otherwise provided in the contract.
(b) In any suit filed under Section 20104.4, the local agency shall pay interest at the legal rate on any arbitration award or judgment. The interest shall begin to accrue on the date the suit is filed in a court of law.
