An act to add Section 12012.2 to the Government Code, relating to tribal affairs.

AB 1495, as introduced, Stephanie Nguyen. Office of Tribal Affairs.
Existing law establishes within the office of the Governor, the office of the Governor’s Tribal Advisor, which is headed by the Governor’s Tribal Advisor who is appointed by and serves at the pleasure of the Governor.
This bill would establish within the office of the Governor, the Office of Tribal Affairs, which would be headed by the Secretary of the Office of Tribal Affairs, would manage the state’s tribal programs, and would help tribes connect with state officers’ tribal leads. The bill would establish a Deputy of Tribal Affairs in every state agency, as defined, and in every constitutional office, as defined. The bill would establish a Tribal Advisor position in the executive office of every state agency, as defined. The bill would require the Governor to appoint a Tribal Advisory Committee, as specified, to the Secretary of the Office of Tribal Affairs.

The people of the State of California do enact as follows:


SECTION 1.

 Section 12012.2 is added to the Government Code, to read:

12012.2.
 (a) There is established within the office of the Governor, the Office of Tribal Affairs, which shall be headed by the Secretary of the Office of Tribal Affairs.
(b) The Office of Tribal Affairs shall manage the state’s tribal programs and help tribes connect with state officers’ tribal leads.
(c) There shall be a Deputy of Tribal Affairs position established in every state agency as defined in Section 11000 and in every constitutional office listed in Section 5 of Article V of the California Constitution. There shall also be a Tribal Advisor position established in the executive office of every state agency listed in Section 11000.
(d) The Secretary of the Office of Tribal Affairs shall perform all duties, exercise all powers, assume and discharge all responsibilities, and carry out and effect all purposes vested by law in the office, including overseeing and coordinating all the activities of each agency’s Deputy of Tribal Affairs and Tribal Advisor positions.
(e) The Governor shall appoint a Tribal Advisory Committee to the Secretary of the Office of Tribal Affairs. The Tribal Advisory Committee shall consist of 12 tribal members, four each from northern, central, and southern California federally recognized tribes.
