An act to amend Section 21 of add Section 654.4 to the Harbors and Navigation Code, relating to vessels.

AB 1087, as amended, Grayson. Vessels. Vessels: equipment.
Existing law generally regulates the operation of vessels and associated equipment used, to be used, or carried in vessels used on waters subject to the jurisdiction of the state.
This bill would require, prior to installation and use, any equipment installed on a commercial harbor craft that interacts with the propulsion system of the craft to be approved for use with the propulsion system, as specified. The bill would require that equipment to include an automatic override or bypass feature that ensures continued power to, and operation of, the craft.

Existing law defines a “vessel” for purposes of the Harbors and Navigation Code to include ships of all kinds, steamboats, steamships, canal boats, barges, sailing vessels, and every structure adapted to be navigated from place to place for the transportation of merchandise or persons.

This bill would make technical, nonsubstantive changes to this definition.

The people of the State of California do enact as follows:


SECTION 1.

 Section 654.4 is added to the Harbors and Navigation Code, to read:

654.4.
 (a) For purposes of this section, “authorized classification society” has the same meaning as provided in Section 8.100 of Title 46 of the Code of Federal Regulations.
(b) Prior to installation and use, any equipment installed on a commercial harbor craft that interacts with the propulsion system of the craft shall be approved for use with the propulsion system by the United States Coast Guard, at least one authorized classification society, and the manufacturer of the propulsion system. The equipment shall include an automatic override or bypass feature that ensures the propulsion system will not lose power and the operability of the harbor craft is not affected, regardless of the operational ability of the installed equipment.

SECTION 1.Section 21 of the Harbors and Navigation Code is amended to read:
21.

“Vessel” includes ships of all kinds, including steamboats, steamships, canal boats, barges, and sailing vessels, and ships of every structure adapted to be navigated from place to place for the transportation of merchandise or persons.
