An act to add Section 116376.5 to, and to add Chapter 10 (commencing with Section 119450) to Part 15 of Division 104 of, the Health and Safety Code, relating to environmental protection.

AB 802, as introduced, Bloom. Microfiber pollution.
Existing law, the California Safe Drinking Water Act, requires the State Water Resources Control Board to administer provisions relating to the regulation of drinking water to protect public health. Existing law requires the state board, on or before July 1, 2020, to adopt a definition of microplastics in drinking water, as provided.
Existing law requires the Ocean Protection Council, to the extent funds are available, to adopt and implement a Statewide Microplastics Strategy related to microplastic materials that pose an emerging concern for ocean health, as provided.
This bill would require the state board to identify the best available control technology for filtering microfibers from an industrial, institutional, or commercial laundry facility on or before an unspecified date, and would require the state board to consult with owners and operators of laundry facilities on the types of filtration systems currently in use and with universities, scientific organizations, and experts on plastic pollution in identifying the best available control technology. The bill would also require, on or before an unspecified date, any entity that operates an industrial, institutional, or commercial laundry facility to adopt the use of the best available control technology to capture microfibers that are shed during washing.

The people of the State of California do enact as follows:


SECTION 1.

 Section 116376.5 is added to the Health and Safety Code, to read:

116376.5.
 (a) On or before ____, the state board shall identify the best available control technology for filtering microfibers from an industrial, institutional, or commercial laundry facility, as those terms are understood by the board.
(b) In identifying the best available control technology pursuant to subdivision (a), the board shall do both of the following:
(1) Consult with owners and operators of laundry facilities on the types of filtration systems currently in use.
(2) Consult with universities, scientific organizations, and experts on plastic pollution.

SEC. 2.

 Chapter 10 (commencing with Section 119450) is added to Part 15 of Division 104 of the Health and Safety Code, to read:

 On or before ____, an entity that operates an industrial, institutional, or commercial laundry facility shall adopt the use of the best available control technology to capture microfibers that are shed during washing, as identified by the state board pursuant to Section 116376.5.
