An act to amend and renumber Section 53599.2 of, and to add Section 53559.4 to, the Health and Safety Code, relating to housing.

Infill Infrastructure Grant Program of 2019.
Existing law establishes the Infill Infrastructure Grant Program of 2019, which requires the Department of Housing and Community Development, upon appropriation of funds by the Legislature, to establish and administer a grant program to allocate funds for capital improvement projects for the development of a qualifying infill project or qualifying infill area, as those terms are defined.
The California Environmental Quality Act (CEQA) requires a lead agency, as defined, to prepare, or cause to be prepared, and certify the completion of an environmental impact report on a project that it proposes to carry out or approve that may have a significant effect on the environment or to adopt a negative declaration if it finds that the project will not have that effect.
This bill would exempt from the requirements
of CEQA a project financed pursuant to the Infill Infrastructure Grant Program of 2019, and would make all legal actions, proceedings, and decisions undertaken or made pursuant to the program exempt from CEQA. The bill would also make nonsubstantive changes to the program by renumbering a code section and updating erroneous cross-references.

The people of the State of California do enact as follows:
SECTION 1.
Section 53559.4 is added to the Health and Safety Code, to read:53559.4.
(a) Notwithstanding any other law, the California Environmental Quality Act (Division 13 (commencing with Section 21000) of the Public Resources Code) shall not apply to any project funded pursuant to this part.(b) All legal actions, proceedings, and decisions undertaken or made pursuant to this part shall be exempt from the requirements of the California Environmental Quality Act (Division 13 (commencing with Section 21000) of the Public Resources Code).
SEC. 2.
Section 53599.2 of the Health and Safety Code is amended and renumbered to read:53599.2.53559.2.
(a) Upon appropriation by the Legislature, the department may expend the sum of five hundred million dollars ($500,000,000) for the Infill Infrastructure Grant Program of 2019, as follows:(1) Four hundred ten million dollars ($410,000,000) shall be allocated to fund grants pursuant to subdivision (c) of Section 53599. 53559.
(2) Ninety million dollars ($90,000,000) shall be allocated to fund grants pursuant subdivision (d) of Section 53599. 53559.
(b) Of the amount appropriated in subdivision (a), 5 percent of the funds shall be set aside for program administration, including state operations expenditures and technical assistance.
