An act to add Section 69894 to the Government Code, relating to courts.

AB 1576, as amended, Committee on Judiciary. Superior court: lactation rooms.
Existing law provides for the classification and appointment of superior court officers, deputies, assistants, and employees as are deemed necessary for the performance of the duties and the exercise of the powers conferred by law upon the superior court and its members. Existing law generally requires the superior court, as an employer, to provide employees with the use of a lactation room or other location for employees to express milk in private. A lactation room or location is required to provide, among other things, a clean and safe place to sit.

This bill would require the superior court to allow an attorney or other officer of the superior court access to a lactation room, or another location, as specified, that is provided to court employees with priority to court employees.

This bill, commencing July 1, 2024, would require the superior court to provide any court user access to a lactation room in any courthouse in which a lactation room is also provided to court employees, as specified. The bill would require the lactation room for court users to be located within the court facility in an area that is accessible to the public or in any location that is reasonably accessible to the public using the court facility. The bill, except as provided, would require the lactation room for court users to meet all of the requirements imposed upon an employer with respect to providing a lactation room for employees.

The people of the State of California do enact as follows:


SECTION 1.

 Section 69894 is added to the Government Code, to read:

69894.
 (a) The superior court shall allow an attorney or other officer of the superior court provide any court user access to a lactation room that is in any courthouse in which a lactation room is also provided to court employees in compliance with Section 1031 of the Labor Code or another location within the court facility, as determined by the court, that meets Code. The lactation room for court users shall be located within the court facility in an area that is accessible to the public or in any location that is reasonably accessible to the public using the court facility. The lactation room for court users shall meet all of the requirements of Section 1031 of the Labor Code. An employee of the superior court shall have priority to use a lactation room before an attorney or other officer of the superior court.
(b) Notwithstanding subdivision (a), a superior court may comply with this section by designating a lactation room for court users without complying with subdivision (d) of Section 1031 of the Labor Code, if due to operational, financial, or space limitations. The lactation room shall not be a bathroom, shall be shielded from view and free from intrusion while it is being used by a court user to express milk, and shall otherwise be compliant with this section.
(c) This section shall become operative on July 1, 2024.
