CALIFORNIA LEGISLATURE— 2019–2020 REGULAR SESSION

Senate Bill
No. 1388

Introduced by Senator Rubio

February 21, 2020

An act to amend Section 1051 of the Water Code, relating to water.

LEGISLATIVE COUNSEL'S DIGEST

SB 1388, as introduced, Rubio. State Water Resources Control Board: powers.
The California Constitution declares that the general welfare requires that the water resources of the state be put to beneficial use to the fullest extent of which they are capable, and that the right to the use of water does not extend to the waste or unreasonable use, method of use, or method of diversion of water. Existing law requires the Department of Water Resources and the State Water Resources Control Board to take all appropriate action to prevent waste, unreasonable use, an unreasonable method of use, or an unreasonable method of diversion of water. Existing law authorizes the board to investigate bodies of water, to take testimony in regard to the rights to water or the use of water, and to ascertain whether or not water is appropriated under the law.
This bill would make nonsubstantive changes in the provisions relating to the authorization of the board to take that testimony and ascertain whether water has been appropriated.
Vote: MAJORITY   Appropriation: NO   Fiscal Committee: NO   Local Program: NO

The people of the State of California do enact as follows:
