An act relating to water. An act to add Chapter 4.7 (commencing with Section 116770) to Part 12 of Division 104 of the Health and Safety Code, relating to drinking water.

AB 2692, as amended, Arambula. Water: Drinking water: infrastructure funding.
Existing law, the Safe Drinking Water State Revolving Fund Law of 1997, establishes the Safe Drinking Water State Revolving Fund to provide grants or revolving fund loans for the design and construction of projects for public water systems that will enable those systems to meet safe drinking water standards. Existing law requires the State Water Resources Control Board to establish eligibility criteria for project financing that is consistent with federal law.
This bill would require the Treasurer to establish the California Safe Drinking Water Revolving Loan Program to provide loans to public water systems to address critical water infrastructure needs of those systems. The bill would establish the California Safe Drinking Water Revolving Loan Fund in the State Treasury and would require the Treasurer, upon appropriation by the Legislature, to expend moneys in the fund for the above purpose.

Under existing law, various measures, including legislative and initiative general obligation bond acts and budget act appropriations, provide funding for water resources projects, facilities, and programs.

This bill would state the intent of the Legislature to enact legislation to establish a permanent source of water infrastructure funding.

The people of the State of California do enact as follows:


SECTION 1.

 Chapter 4.7 (commencing with Section 116770) is added to Part 12 of Division 104 of the Health and Safety Code, to read:
CHAPTER  4.7. California Safe Drinking Water Revolving Loan Act
Article  1. General Provisions

 This chapter shall be known, and may be cited, as the California Safe Drinking Water Revolving Loan Act.

 For purposes of this chapter, “public water system” has the same meaning as set forth in Section 113275.

Article  2. California Safe Drinking Water Revolving Loan Program

 The Treasurer shall develop and implement the California Safe Drinking Water Revolving Loan Program to provide loans to public water systems to address critical water infrastructure needs of those public water systems.

Article  3. California Safe Drinking Water Revolving Loan Fund

 There is hereby established in the State Treasury the California Safe Drinking Water Revolving Loan Fund. Moneys in the fund, upon appropriation by the Legislature, shall be expended by the Treasurer for the implementation of this chapter.

SECTION 1.

It is the intent of the Legislature to enact legislation to establish a permanent source of water infrastructure funding.
