AB-2719 Vehicles: commercial vehicle inspections.(2023-2024)



As Amends the Law Today


SECTION 1.

 Section 2813 of the Vehicle Code is amended to read:

2813.
 (a)  Every driver of a commercial vehicle shall stop and submit the vehicle to an inspection of the vehicle’s size, weight, equipment, loading, and smoke emissions, as well as the driver’s license, medical qualifications, and hours-of-service compliance of a driver of the vehicle at any location where members of the California Highway Patrol are conducting tests and inspections of commercial vehicles and when signs are displayed requiring the stop. Every driver who fails or refuses to stop and submit the vehicle to an inspection when signs are displayed requiring that stop is guilty of a misdemeanor.
(b) This section does not apply to a vehicle that is displaying a valid and unexpired sticker issued for that vehicle pursuant to Section 2813.5 or 2813.6.

SEC. 2.

 Section 2813.6 is added to the Vehicle Code, to read:

2813.6.
 (a) A public transit agency may request the Department of the California Highway Patrol to annually inspect each commercial vehicle and transit vehicle in its fleet and, as appropriate, certify that its condition meets minimum safety standards established by the Department of the California Highway Patrol.
(b) The commissioner shall have the exclusive authority in the issuance of stickers or other devices as evidence that a commercial vehicle or transit vehicle has been inspected and certified to be in compliance with minimum safety standards. The commissioner may make and enforce regulations with respect to the issuance and display of stickers or other devices issued pursuant to this subdivision.
(c) A vehicle that has been inspected and certified pursuant to this section and is displaying a sticker or other device issued pursuant to this section, as required by the commissioner, is exempt from the requirement to stop for inspection pursuant to Section 2813.
(d) As used in this section, “public transit agency” has the same meaning as “public transportation operator” as defined in Section 99312.2 of the Public Utilities Code, and “transit vehicle” has the same meaning as in Section 99501 of the Public Utilities Code.
