As Amends the Law Today


SECTION 1.

 Section 19080.3 of the Government Code is amended to read:

19080.3.
 Limited term  Limited-term  appointments shall be made only for temporary staffing needs and shall not individually or consecutively exceed one year, provided that the board may authorize limited term appointments of up to a total of two years’ duration when a permanent appointment would be likely to cause a layoff, demotion, or mandatory transfer requiring a change of residence upon the conclusion of the temporary staffing need. Limited term appointments may be extended within the time limits prescribed by this section without making an additional appointment. 24 months. 

SEC. 2.

 Section 19080.5 of the Government Code is amended to read:

19080.5.
 (a) Notwithstanding Section 19080.3, a limited term  A limited-term  appointment for a period not to exceed two years may be made to professional education classifications established for use by the State  Department of Education to facilitate the professional development of experienced professional educators. Any individual may not receive more than one such appointment within a five-year period. The number of such appointments at any point in time shall not exceed 10 percent of the professional education staff employed by the State  Department of Education. The request for certification shall state the duration of the appointment. The provisions of this section shall not apply to any person employed by the State  Department of Education in a civil service position on the effective date of this section.
(b) If the provisions of this section are in conflict with the provisions of a memorandum of understanding reached pursuant to Section 3517.5, the memorandum of understanding shall be controlling without further legislative action, except that if such provisions of a memorandum of understanding require the expenditure of funds, the provisions shall not become effective unless approved by the Legislature in the annual Budget Act.
