As Amends the Law Today


SECTION 1.

 Section 89700.2 is added to the Education Code, to read:

89700.2.
 (a) As used in this section, the following definitions apply:
(1) “Federal methodology” means the methodology set forth in federal law or regulation for determining the expected family contribution of students seeking any state-funded financial assistance.
(2) “Institutional financial aid” means financial aid that is paid for by the California State University from its funds and the recipient of which is selected by the California State University.
(b) The California State University shall not charge tuition or mandatory systemwide fees for enrollment at a campus of the university for any academic year, for up to two academic years, to a California Community College transfer student who has completed an associate degree for transfer and demonstrates financial need in accordance with the federal methodology.
(c) (1) The chancellor shall distribute funding appropriated for purposes of this section to each California State University campus to offset the costs of waiving tuition and mandatory systemwide fees pursuant to subdivision (b). It is the intent of the Legislature that sufficient funding be allocated to each participating campus to offset the cost of all tuition and mandatory systemwide fee waivers granted pursuant to subdivision (b).
(2) The chancellor shall first allocate funding appropriated for purposes of this section to each California State University campus to offset the costs of waiving tuition and mandatory systemwide fees for each student whose expected family contribution, as determined by the federal methodology, is 0 percent. Any remaining funding shall be allocated to each California State University campus to offset the costs of waiving tuition and mandatory systemwide fees for each student whose expected family contribution, as determined by the federal methodology, is less than 50 percent.
(d) (1) The California State University shall waive tuition and mandatory systemwide fees pursuant to this section in a manner that supplements, does not supplant, and maximizes, student access to institutional and need-based financial aid. Students who qualify to have their tuition and mandatory systemwide fees waived under this section, have financial need, and have all or a portion of their tuition and mandatory systemwide fees waived by other financial aid programs shall receive a grant in the amount of tuition and fees that would have otherwise been waived pursuant to subdivision (b) to help cover their nontuition college costs.
(2) The California State University shall ensure that qualifying students, as a condition of having tuition and mandatory fees waived pursuant to this section, complete the Free Application for Federal Student Aid, application for a state university grant, or California Dream Act application.
(e) The Legislature finds and declares, within the meaning of subsection (d) of Section 1621 of Title 8 of the United States Code, that undocumented persons who complete and submit the California Dream Act application and meet the requirements of subdivision (b) shall be eligible to have their tuition and mandatory systemwide fees waived under this section.
(f) This section shall be implemented only upon the appropriation of funds for its purposes.
