AB-513 Employment: telecommuting employees.(2021-2022)



As Amends the Law Today


SECTION 1.

 Chapter 5 (commencing with Section 1410) is added to Part 4 of Division 2 of the Labor Code, to read:

CHAPTER  5. Telecommuting Employees
1410.
 (a) (1) An employee who works from home or a remote location that is not at the physical location of the employer may receive all required notices and postings under this code electronically.
(2) Any employee in this category who does not have the ability to receive electronic notices and postings may be given that notice by mail.
(b) An employee who works from home or a remote location that is not at the physical location of the employer may utilize an electronic signature or electronic acknowledgment for any employment-related documents that require acknowledgment of receipt or attestation.
(c) An employee who works from home or a remote location that is not at the physical location of the employer may have any wages due at the time of separation of employment mailed to the employee using the address the employer has on file for the employee for sending notices. Those wages shall be deemed to have been paid on the date of mailing.
