AB-284 Department of Justice: officer-involved shootings: report.(2017-2018)

As Amends the Law Today


 Section 12525.4 is added to the Government Code, to read:

 (a) Pursuant to Article 2 (commencing with Section 11180) of Chapter 2 of Part 1 of Division 3 of Title 2, the Department of Justice shall conduct a study of all or a sample of peace officer-involved shootings resulting in death or serious injury that occurred in California between January 1, 2015, and December 31, 2016. The department shall conduct a study of all or a sample of those incidences that includes, but is not limited to, all of the following:
(1) The nature and the circumstances of each incident and the characteristics of the individuals involved.
(2) The policies, procedures, and training of the agency that employed the peace officer.
(3) The oversight and investigation of peace officer-involved shootings and serious uses of force.
(b) By April 1, 2018, the department shall confer with stakeholders, as determined by the department, regarding officer-involved shootings and serious uses of force.
(c) By July 1, 2019, or within 18 months of the receipt of funding pursuant to subdivision (e), whichever is later, the department shall prepare a written report describing its findings and recommendations and make that report available to the public.
(d) The study conducted pursuant to this section does not constitute a civil or criminal investigation and does not take the place of all appropriate internal affairs investigations or criminal investigations.
(e) The department shall implement the requirements of this section only to the extent that the Legislature appropriates funding for that purpose.
