(a) The Judicial Council shall, in accordance with the recommendation of the Commission on the Future of California’s Court System, develop a proposal on or before January 1, 2021, to evaluate and implement a model for civil adjudication of minor vehicle infractions.(b) At least once before January 1, 2020, the Judicial Council shall conduct a public hearing at which interested parties may present testimony related to the transition to civil adjudication of minor vehicle infractions. The Judicial Council shall retain discretion regarding the number and timing of additional public hearings.
(c) (1) Between January 1, 2019, and January 31, 2021, the Judicial Council shall prepare and submit status reports to the Legislature at six-month intervals.
(2) The status reports shall detail the Judicial Council’s efforts to evaluate and implement a model for civil adjudication of minor vehicle infractions.
(3) The status reports shall be submitted in compliance with Section 9795 of the Government Code.
(4) (A) Unless otherwise prohibited by statute or rule of court, the first status report after the public hearing conducted pursuant to subdivision (b) shall include a description of the topics and issues discussed at the public hearing, including responses to specific questions, feedback on recommendations, and other information presented by the public.
(B) If the Judicial Council conducts additional public hearings pursuant to subdivision (b), subsequent status reports may include the information described in subparagraph (A).
(5) Nothing in this section shall be construed to require additional reports or reports submitted at intervals different than those required by paragraph (1).
(d) If the Judicial Council concludes, after public hearing and consideration of feedback from interested parties, that civil adjudication of minor vehicle infractions is advisable, the Judicial Council shall submit the proposal developed pursuant to subdivision (a) to the Legislature in compliance with Section 9795 of the Government Code.
