AB-2362 Safe transportation of dogs and cats.(2017-2018)



As Amends the Law Today


SECTION 1.

 Chapter 12 (commencing with Section 122390) is added to Part 6 of Division 105 of the Health and Safety Code, to read:

CHAPTER  12. Safe Transportation of Dogs and Cats
122390.
 This chapter shall be known, and may be cited, as the Safe Transportation of Dogs and Cats Act.
122390.1.
 For purposes of this chapter, “mobile or traveling housing facility” means a transporting vehicle, including, but not limited to, a car, truck, trailer, bus, or recreational vehicle used to transport animals by an entity described in Section 122390.6.
122390.2.
 A mobile or traveling housing facility for dogs and cats shall be sufficiently heated and cooled when necessary to protect the dogs and cats from temperature or humidity extremes so as to provide for their health and well-being.
122390.3.
 The ambient temperature in a mobile or traveling housing facility shall not fall below 50 degrees Fahrenheit (10 degrees Celsius) for dogs and cats not acclimated to lower temperatures, for those breeds, such as dogs with little fur, that cannot tolerate lower temperatures without stress or discomfort, and for sick, aged, young, or infirm dogs and cats. Dry bedding, solid resting boards, or other methods of conserving body heat shall be provided when temperatures are below 50 degrees Fahrenheit (10 degrees Celsius). The ambient temperature shall not fall below 45 degrees Fahrenheit (7.2 degrees Celsius) for more than four consecutive hours when dogs or cats are present, and shall not exceed 85 degrees Fahrenheit (29.5 degrees Celsius) for more than four consecutive hours when dogs or cats are present. The requirements of this section are in addition to, and not in place of, all other requirements pertaining to climatic conditions in this chapter or otherwise required by law.
122390.4.
 A mobile or traveling housing facility for dogs and cats shall be sufficiently ventilated at all times when dogs or cats are present to provide for the health and well-being of the animals, and to minimize odors, drafts, ammonia levels, moisture condensation, and exhaust fumes. Ventilation shall be provided by means of windows, doors, vents, fans, or air-conditioning. Auxiliary ventilation, such as fans, blowers, or air-conditioning, shall be provided when the ambient temperature within the animal housing area is 85 degrees Fahrenheit (29.5 degrees Celsius) or higher. The requirements of this section are in addition to, and not in place of, all other requirements pertaining to climatic conditions in this chapter or otherwise required by law.
122390.5.
 Mobile or traveling housing facilities for dogs and cats shall be sufficiently well lit to permit proper cleaning and inspection of the facility, and observation of the dogs and cats. Animal areas shall be provided a regular diurnal lighting cycle of either natural or artificial light. Lighting shall be uniformly diffused throughout animal facilities and provide sufficient illumination to aid in maintaining good housekeeping practices, adequate cleaning, adequate inspection of animals, and for the well-being of the animals.
122390.6.
 This chapter applies to any public animal control agency or shelter, society for the prevention of cruelty to animals shelter, humane society shelter, or rescue group that is in a cooperative agreement with at least one private or public shelter pursuant to Section 31108, 31752, or 31753 of the Food and Agricultural Code.
