SB-553 State property: Department of Forestry and Fire Protection.(2007-2008)



As Amends the Law Today


SECTION 1.
 (a) The Legislature finds and declares the following:
(1) The state owns approximately three acres of real property located at 875 Cypress Avenue in the City of Redding, referred to as the Cypress property for purposes of this section, that is used by the Department of Forestry and Fire Protection as its Shasta-Trinity Unit Headquarters. The facilities located on this property include an emergency command center, an auto shop, a warehouse, and an administration office.
(2) The department has outgrown the deteriorating facilities on the Cypress property.
(b) The Legislature intends all of the following:
(1) The Director of General Services be authorized to lease, sell, or exchange the Cypress property or to both sell the Cypress property and exchange it for another parcel of real property.
(2) The director initially be required to offer the Cypress property, pursuant to the authorization described in paragraph (1), to the City of Redding and if the city is unable to enter into an agreement for the property’s disposition, that the director be allowed to dispose of the Cypress property, as described in paragraph (1), by an agreement with another party.
(3) The proceeds of the disposition of the Cypress property be used by the state for the sole purpose of consolidating and expanding the administrative operations of the department for the protection of the health and safety of the residents of this state.

SEC. 2.

 Section 14673.9 is added to the Government Code, to read:

14673.9.
 (a) The Director of General Services may lease, sell, or exchange the approximately three-acre parcel of real property located at 875 Cypress Avenue in the City of Redding, or a portion of that property, used by the Department of Forestry and Fire Protection as its Shasta-Trinity Unit Headquarters, hereafter referred to as the Cypress property. The director may also enter into an agreement in which the Cypress property is sold and exchanged for another parcel of real property or improvements to real property.
(b) The disposition of the Cypress property pursuant to subdivision (a) shall be upon terms and conditions the director determines are in the best interest of the state, and shall be for not less than the fair market value of the property.
(c) The director shall initially offer the Cypress property for disposition, pursuant to the authorization described in subdivision (a), to the City of Redding. If the City of Redding is unable to enter into an agreement for the disposition of the Cypress property, the director may offer the Cypress property for disposition, as described in subdivision (a), to the public through a competitive process determined by the director to be in the best interest of the state.
(d) The Department of General Services shall be reimbursed for any cost or expense incurred in the disposition of the Cypress property, as described in subdivision (a), from the proceeds of that disposition.
