SEC. 2.
This act is an urgency measure necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the Constitution and shall go into immediate effect. The facts constituting the necessity are:There is an unprecedented fiscal crisis in the funding of municipal, superior, and justice courts and criminal justice facilities and the furniture, fixtures, and equipment necessary to place the courts and criminal justice facilities into operation. Revenues for the funding of court and criminal justice facilities funding have been less than anticipated due to the economic recession, the inability of traffic and parking law violators to pay penalty assessments, and the use by the courts of alternatives to monetary penalties. This act will provide counties of the first class which have established courthouse and criminal justice facilities construction funds needed authority to transfer moneys from one such fund to another, as needed to meet obligations in construction projects, to acquire fixtures, furniture, equipment, and other items necessary to put buildings to use in a timely manner, and to use those transfers to take advantage of opportunities to achieve overall cost savings.
