AB-1351 Department of Food and Agriculture: civil executive officer.(1993-1994)



As Amends the Law Today


SECTION 1.

 Section 35 of the Food and Agricultural Code is amended to read:

35.
 “Secretary” means the Secretary of Food and Agriculture.

SEC. 2.

 Section 50 of the Food and Agricultural Code is amended to read:

50.
 Whenever the term “department” or “Department of Agriculture” appears in any law, it means the “Department of Food and Agriculture.”
Whenever the term “director,” “secretary,” “Director of Agriculture,” or “Secretary of Agriculture” appears in any law, it means the “Secretary of Food and Agriculture.”
Whenever the term “Agricultural Code” appears in any law, it means the “Food and Agricultural Code.”

SEC. 3.

 Section 102 of the Food and Agricultural Code is amended to read:

102.
 The department is under the control of a civil executive officer known as the Secretary of Food and Agriculture who shall receive the salary provided for by Chapter 6 (commencing with Section 11550) of Part 1 of Division 3 of Title 2 of the Government Code. He or she shall be appointed by, and hold office at the pleasure of, the Governor.

SEC. 4.

 Section 103 of the Food and Agricultural Code is amended to read:

103.
 Except as is otherwise provided in this chapter, Chapter 2 (commencing with Section 11150) of Part 1 of Division 3 of Title 2 of the Government Code governs and applies to the conduct of the department in every respect the same as if those provisions were set forth in this code, and whenever in that chapter the term “head of the department” or similar designation occurs, for the purpose of this code it means the secretary.

SEC. 5.

 Section 104 of the Food and Agricultural Code is amended to read:

104.
 The secretary may appoint and in accordance with law fix the salaries of such assistants, deputies, agents, experts, and other employees as are necessary for the administration of the department.

SEC. 6.

 Section 11550 of the Government Code is amended to read:

11550.
 (a)  Effective January 1, 1988, an annual salary of ninety-one thousand fifty-four dollars ($91,054) shall be paid to each of the following:
(1) (a)   Director of Finance.  
(2) (b)   Secretary of Transportation. Business, Transportation and Housing Agency.  
(3) (c)   Secretary of the Natural  Resources Agency.  
(4) (d)   Secretary of California  Health and Human Services. Welfare Agency.  
(5) (e)   Secretary of Business, Consumer Services, and Housing. State and Consumer Services Agency.  
(f)  Director of Industrial Relations.
(6) (g)   Commissioner of the California Highway Patrol.  
(7) (h)   Secretary of the Department of Corrections and Rehabilitation. Youth and Adult Correctional Agency.  
(8) (i)   Secretary of Food and Agriculture.  
(9) (j)   Secretary of Veterans Affairs. Trade and Commerce Agency.  
(10) Secretary of Labor and Workforce Development.
(11) Secretary for Environmental Protection.
(12) Secretary of Government Operations.
(b)  The annual compensation provided by this section shall be increased in any fiscal year in which a general salary increase is provided for state employees. The amount of the increase provided by this section shall be comparable to, but shall not exceed, the percentage of the general salary increases provided for state employees during that fiscal year.
