An act to add Section 22527 to the Vehicle Code, relating to vehicles.

AB 1192, as introduced, Beth Gaines. Vehicles: parking: motorcycles.
Existing law establishes requirements regarding the parking of motor vehicles. Existing law authorizes a local authority, by ordinance or resolution, to establish parking requirements for motor vehicles within the local authority’s jurisdiction. Existing law, except as otherwise specified, makes it unlawful and constitutes an infraction for any person to violate, or fail to comply with any provision of the Vehicle Code, or any local ordinance adopted pursuant to the Vehicle Code.
This bill would prohibit an owner or operator of a public or private offstreet parking facility from prohibiting motorcycles from using the facility. The bill would also prohibit a local authority from prohibiting a motorcycle from parking at a location at which other motor vehicles are authorized to park. Because a violation of this provision is a crime, this bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that no reimbursement is required by this act for a specified reason.

The people of the State of California do enact as follows:


SECTION 1.

 Section 22527 is added to the Vehicle Code, to read:

22527.
 (a) An owner or operator of a public or private offstreet parking facility shall not prohibit motorcycles from using the parking facility.
(b) A local authority shall not prohibit a motorcycle from parking at a location at which other motor vehicles are authorized to park.

SEC. 2.

 No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII B of the California Constitution.
