An act to amend Section 42280 of the Education Code, relating to school finance.

AB 2651, as introduced, Megan Dahle. School finance: necessary small schools.
Existing law requires, for each school district that includes a necessary small school, as defined, in the current or prior fiscal year, the Superintendent of Public Instruction to compute a specified funding allocation for each necessary small school in the school district. Existing law requires that funding allocation to be the greater of either the amount calculated based on prior year average daily attendance or the amount calculated based on current year average daily attendance, as provided.
This bill would instead require the Superintendent to make that funding allocation for each school district that includes a necessary small school in the current fiscal year or any of the 3 most recent prior fiscal years. The bill would require the funding allocation to be the greater of the amount calculated based on current year average daily attendance or the amount based on the fiscal year in which the funding level would be the greatest out of the 3 most recent prior fiscal years.

The people of the State of California do enact as follows:


SECTION 1.

 Section 42280 of the Education Code is amended to read:

42280.
 (a) For each school district that meets, in the current or prior fiscal year, fiscal year or any of the three most recent prior fiscal years, the conditions specified in Section 42282 or 42284 42284, the Superintendent shall compute, for each qualifying school in the school district, an amount pursuant to this article.
(b) (1) For each qualified school district, the Superintendent shall compute for each of the three most recent prior fiscal years the sum of necessary small elementary school allowances determined pursuant to Section 42282 for the average daily attendance in the fiscal year and the number of full-time teachers and necessary small high school allowances determined pursuant to Section 42284 for the average daily attendance in the fiscal year and the number of certificated employees.

(b)

(2) The amount of funding for each qualified school district shall equal the greater of either of the following:

(1)The sum of necessary small elementary school allowances determined pursuant to Section 42282 for the prior year average daily attendance and the number of full-time teachers, and necessary small high school allowances determined pursuant to Section 42284 for the prior year average daily attendance and the number of certificated employees.

(A) The amount of funding calculated pursuant to paragraph (1) for the fiscal year in which the amount of funding calculated pursuant to paragraph (1) is the greatest.

(2)

(B) The sum of necessary small elementary school allowances determined pursuant to Section 42282 for the current year average daily attendance and the number of full-time teachers, and necessary small high school allowances determined pursuant to Section 42284 for the current year average daily attendance and the number of certificated employees.
