CALIFORNIA LEGISLATURE— 2019–2020 REGULAR SESSION

Assembly Bill
No. 1426

Introduced by Assembly Member Boerner Horvath

February 22, 2019

An act to amend Section 30522 of add Section 5002.8 to the Public Resources Code, relating to coastal resources. state beaches.

LEGISLATIVE COUNSEL'S DIGEST

AB 1426, as amended, Boerner Horvath. Coastal resources: certification of local coastal programs. State beaches: San Onofre State Beach: report on encroaching state or local agency infrastructure project.
Existing law vests the Department of Parks and Recreation with control of the state park system, which includes state beaches.
This bill would require the department to report to specified policy committees of the Legislature about any proposed state or local agency infrastructure project that would encroach or interfere with the operation of San Onofre State Beach.

The California Coastal Act of 1976 establishes the California Coastal Commission, and prescribes procedures for the preparation, approval, and certification of local coastal programs that regulate development in the coastal zone, as defined, in jurisdictions that have a certified local coastal program. The act specifies that it does not permit the commission to certify a local coastal program that provides for a lesser degree of environmental protection than that provided by the plans and policies of any state regulatory agency that are formally adopted by that agency, are used in the regulatory program of that agency, and are legally enforceable.

This bill would make nonsubstantive changes in that latter provision.

Vote: MAJORITY   Appropriation: NO   Fiscal Committee: NOYES   Local Program: NO

The people of the State of California do enact as follows:

SECTION 1.

Section 5002.8 is added to the Public Resources Code, to read:

SECTION 1.Section 30522 of the Public Resources Code is amended to read:
30522.

Nothing in this chapter shall permit the commission to certify a local coastal program that provides for a lesser degree of environmental protection than that provided by the plans and policies of any state regulatory agency that are formally adopted by that agency, are used in the regulatory program of that agency, and are legally enforceable.
