An act to add Section 8592.42 to the Government Code, relating to information technology.

AB 2812, as amended, Limón. Data storage and protection standards: local agencies.
Existing law requires the Department of Technology, on or before July 1, 2018, to update the Technology Recovery Plan element of the State Administrative Manual to ensure the inclusion of cybersecurity strategy incident response standards for each state agency, as specified. Existing law authorizes a local entity that receives state funds for the purposes of storing, sharing, or transmitting data, or in support of an information technology project with a state entity, to submit a Technology Recovery Plan, upon request of the Department of Technology.
This bill would create the Office of Local Cloud Migration and Digital Innovation in the Department of Technology, contingent upon the appropriation of the necessary funds by the Legislature. Technology. The bill would require the office to promote cloud-based data storage as an efficient and cost-effective means of data storage and protection for local agencies and to assist local agencies in integrating cloud-based storage into their information technology systems and their technology recovery plans, as specified. the use of technologies including, but not limited to, cloud-based computing and data storage that will assist local agencies in their efforts to further transparency, efficiency, disaster preparedness and response, as well as general accessibility to the public. The bill would require the office to operate in partnership with private industry and the nonprofit community to maximize the assistance provided to local agencies. The bill would create the Cloud Local Cloud Migration and Digital Innovation Local Assistance Fund for the purpose of receipt of donations from private industry and the nonprofit community, and funds directly allocated by the Legislature, and would make money in the fund available to the office, upon appropriation by the Legislature, for the above-described purposes.

The people of the State of California do enact as follows:


SECTION 1.

 The Legislature finds and declares all of the following:
(a) Cloud-based computing technologies, including data storage, are an efficient and cost-effective basis for providing information technology to local agencies.
(b) The Department of Technology has established statewide contract vehicles for cloud computing and storage. These contract vehicles may be utilized by local government agencies, and the Department of Technology has a fee-for-service component in these contract vehicles so that the increased use of these contract vehicles by local government agencies will support the creation and maintenance of the Office of Local Cloud Migration and Digital Innovation.
(c) The agility and elasticity of the cloud can decrease local government agencies’ information technology costs surrounding disaster recovery. Local agency information can be securely stored and protected in the cloud without the threat of a single local government facility being damaged or destroyed during a natural disaster. In addition, local agencies can build cloud-based applications allowing them to better serve their communities during a disaster, including dissemination of real-time traffic and safety information.
(d) The United States Digital Service’s mission to pair private sector technologists with public servants in order to improve the federal government’s most important and digital services is a model worthy of emulation by the State of California. It the intent of the Legislature that leveraging this private sector expertise is vital to ensure that local agencies find innovative ways to provide essential services and improve the quality of life for all residents of California. It is the intent of the Legislature to assist local agencies in their efforts to improve governmental transparency, efficiency, disaster preparedness and response, as well as general accessibility through readily available and cost-efficient technologies.

SECTION 1.SEC. 2.

 Section 8592.42 is added to the Government Code, to read:

8592.42.
 (a) Contingent upon the appropriation of the necessary funds by the Legislature, the The Department of Technology shall create the Office of Local Cloud Migration. Migration and Digital Innovation.
(b) The Office of Local Cloud Migration and Digital Innovation shall promote cloud-based data storage as an efficient and cost-effective means of data storage and protection for local agencies and shall assist local agencies in integrating cloud-based storage into their information technology systems and their technology recovery plans. The office shall prioritize providing assistance to local agencies that are identified as needing to improve their information technology systems to more accessible and cost-effective cloud-based storage. the use of technologies including, but not limited to, cloud-based computing and data storage that will assist local agencies in their efforts to further transparency, efficiency, disaster preparedness and response, as well as general accessibility to the public. The office shall assist local agencies in providing direction on the most cost-effective ways to integrate all applicable technologies that advance the goals set forth in this section. Those technologies shall include, but are not limited to, cloud-based computing and data storage and the integration of that technology into local agency information technology systems and technology recovery plans.
(c) The Office of Local Cloud Migration and Digital Innovation shall prioritize providing assistance to local agencies seeking to improve their information technology systems to migrate to more accessible and cost-effective cloud-based or other applicable technology solutions.

(c)(1)

(d) The Office of Local Cloud Migration and Digital Innovation shall operate in partnership with private industry and the nonprofit community to maximize the assistance provided to local agencies.

(e) There is hereby created in the State Treasury the Cloud Migration and Digital Innovation Local Assistance Fund, for the purpose of receipt of donations from private industry and the nonprofit community. community, and funds directly allocated by the Legislature. Moneys in the fund, upon appropriation by the Legislature, shall be available to the Office of Local Cloud Migration and Digital Innovation for support of the purposes described in subdivision (b).
