CALIFORNIA LEGISLATURE— 2017–2018 REGULAR SESSION

Assembly Bill No. 2195

Introduced by Assembly Member Chau

February 12, 2018

An act to amend Section 39607.4 of the Health and Safety Code, relating to greenhouse gases.

LEGISLATIVE COUNSEL'S DIGEST

AB 2195, as amended, Chau. Natural gas: out-of-state sources: greenhouse gases.
The California Global Warming Solutions Act of 2006 designates the State Air Resources Board as the state agency charged with monitoring and regulating sources of emissions of greenhouse gases. Existing law requires the state board to prepare, adopt, and update an inventory of greenhouse gas emissions that, prior to January 1, 2007, was required to be adopted and updated by the State Energy Resources Conservation and Development Commission.
This bill bill, beginning January 1, 2020, would additionally require the state board to quantify, report, and continually update in that inventory of greenhouse gas emissions the amount of greenhouse gas emissions resulting from the loss or release of uncombusted natural gas leakage and venting during to the atmosphere and emissions from natural gas flares during all processes associated with the production, processing, and transporting of natural gas imported into the state from out-of-state sources.
Vote: MAJORITY   Appropriation: NO   Fiscal Committee: YES   Local Program: NO

The people of the State of California do enact as follows:

SECTION 1.

Section 39607.4 of the Health and Safety Code is amended to read:

39607.4.
 (a) As part of its responsibilities under Section 39607, and in order to streamline, consolidate, and unify the inventory of air emissions under one agency in state government, the state board shall prepare, adopt, and update the inventory formerly required to be adopted and updated by the State Energy Resources Conservation and Development Commission pursuant to Chapter 8.5 (commencing with Section 25730) of Division 15 of the Public Resources Code.
(b) (1) Commencing January 1, 2019, 2020, the state board, based on the best available science and information, shall quantify and report in the inventory required pursuant to subdivision (a) the amount of greenhouse gas emissions emissions, expressed in metric tons of carbon dioxide equivalents, resulting from the loss or release of uncombusted natural gas leakage and venting during to the atmosphere and emissions from natural gas flares during all processes associated with the production, processing, and transporting of natural gas that is imported into the state from out-of-state sources.
(2) Nothing in this subdivision shall be interpreted as expanding, contracting, or otherwise altering other requirements for greenhouse gas emissions reporting by sources or categories of sources or for the statewide greenhouse gas emissions limit.
