An act to amend Section 300 of the Streets and Highways add Section 14673.2 to the Government Code, relating to highways. state property.

AB 3068, as amended, Gloria. State highway system. property: City of San Diego.
Existing law authorizes the Director of General Services to acquire and convey real property for the state, whenever that transfer of the real property is authorized or contemplated by law.
This bill would authorize the director, in consultation with the Department of Transportation, to sell specified real property in the City of San Diego to the city for active transportation, affordable housing, or park purposes.

Existing law vests the Department of Transportation with full possession and control of all state highways. Existing law describes the authorized routes in the state highway system and establishes a process for adoption of a highway on an authorized route by the California Transportation Commission. Existing law requires the commission to relinquish to local agencies state highway segments that have been deleted from the state highway system by legislative enactment, and in certain other cases.

This bill would make nonsubstantive changes to the provision relating to the routes in the state highway system.

The people of the State of California do enact as follows:


SECTION 1.

 Section 14673.2 is added to the Government Code, to read:

14673.2.
 (a) The Legislature finds and declares both of the following:
(1) The state owns all of the following real property:
(A) Parcel Number DD 16555 located between State Route 75, Cesar E. Chavez Parkway, and National Avenue in the City of San Diego.
(B) Parcel Numbers 18944 and 18945 located between Boston Avenue, Interstate 5, South 28th Street, and South 29th Street in the City of San Diego.
(C) Parcel Numbers 18061 and 18058 located between Main Street, Interstate 5, South 32nd Street, and Chollas Creek in the City of San Diego.
(2) The sale of the real property described in paragraph (1), as authorized in subdivision (b), does not constitute a sale of surplus state property within the meaning of Section 9 of Article III of the California Constitution and shall not be subject to subdivision (g) of Section 11011.
(b) The Director of General Services, in consultation with the Department of Transportation, may sell all or a portion of the real property described in paragraph (1) of subdivision (a) to the City of San Diego for active transportation, including for use as a pedestrian and bike path, affordable housing, or park purposes.
(c) For purposes of this section, the real property described in paragraph (1) of subdivision (a) shall not be subject to Section 11011.1.

SECTION 1.Section 300 of the Streets and Highways Code is amended to read:
300.

(a)The state highway system consists of the routes described in this article.

(b)It is the intent of the Legislature, in enacting this article, that the routes of the state highway system serve the state’s heavily traveled rural and urban corridors, that they connect the communities and regions of the state, and that they serve the state’s economy by connecting centers of commerce, industry, agriculture, mineral wealth, and recreation.
