An act to add Sections 10261.7 and 20104.60 to the Public Contract Code, relating to public contracts.


LEGISLATIVE COUNSEL'S DIGEST


AB 1223, as amended, Caballero. Construction contract payments: Internet Web site posting.
Existing law imposes specified requirements on state and local agencies regarding payment of construction contracts.
This bill would require, within 10 21 days of making a construction contract payment, a state or local agency that maintains an Internet Web site to post on its Internet Web site the project for which the payment was made, the name of the construction contractor or company paid, the date the payment was made, the payment application number or other identifying information, and the amount of the payment. The bill would exempt construction contracts valued below $25,000 from these provisions.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

The people of the State of California do enact as follows:


SECTION 1.

 Section 10261.7 is added to the Public Contract Code, to read:

10261.7.
 (a) Within 10 21 days of making a construction contract payment, a state agency that maintains an Internet Web site shall post on its Internet Web site the following:

(a)

(1) The project for which the payment was made.

(b)

(2) The name of the construction contractor or company paid.

(c)

(3) The date the payment was made.

(d)

(4) The payment application number or other identifying information.

(e)

(5) The amount of the payment.
(b) This section shall not apply to a construction contract valued below twenty-five thousand dollars ($25,000).

SEC. 2.

 Section 20104.60 is added to the Public Contract Code, immediately following Section 20104.50, to read:

20104.60.
 (a) Within 10 21 days of making a construction contract payment, a local agency that maintains an Internet Web site shall post on its Internet Web site the following:

(a)

(1) The project for which the payment was made.

(b)

(2) The name of the construction contractor or company paid.

(c)

(3) The date the payment was made.

(d)

(4) The payment application number or other identifying information.

(e)

(5) The amount of the payment.
(b) This section shall not apply to a construction contract valued below twenty-five thousand dollars ($25,000).

SEC. 3.

 If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
