February 20, 2003

An act relating to civil actions.

LEGISLATIVE COUNSEL'S DIGEST

AB 1088, as introduced, Harman. Multiple defendants: joint and several liability.
Existing law governs liability in contract actions in which multiple defendants are liable. Under existing law, the court may proceed against any of the defendants who are served in the action as if they were the only defendants in the action.
This bill would declare the Legislature’s intent to address the application of those provisions to complex civil actions.

The people of the State of California do enact as follows:

SECTION 1.

It is the intent of the Legislature to address the application of Section 410.70 of the Code of Civil Procedure to complex civil actions.
