An act to add Section 5070.5 to the Vehicle Code, relating to vehicles.

AB 2702, as amended, Cunneen. Vehicles: Internet special interest license plates.
Existing law requires the Department of Motor Vehicles to issue special interest license plates, as specified, to any person, to be displayed in lieu of regular license plates.
This bill would add an Internet special interest license plate to the special interest license plate program, as specified. The bill would require that the additional fees collected for the issuance of those special interest license plates, other than fees for the issuance of environmental license plates, as prescribed, be deposited in the Internet Educational Account, created by the bill, in the General Fund, to be used by low-performing schools, as specified, upon appropriation, to fund Internet educational programs.

The people of the State of California do enact as follows:


SECTION 1.

 Section 5070.5 is added to the Vehicle Code, to read:

5070.5.
 (a) (1) The department, in consultation with the Department of the California Highway Patrol and ____, shall design and make available for issuance pursuant to Section 5060, except as provided in paragraph (2), Internet special interest license plates.
(2) Internet special interest license plates may be issued in a combination of numbers and letters, or both, as requested by the applicant for the plates, and, notwithstanding subdivision (a) of Section 5060, shall be followed on the right side of the plate by “.com”, if approved by the Department of the California Highway Patrol.
(3) Any person described in Section 5101, upon payment of the additional fees set forth in subdivision (b), may apply for and be issued a set of these special interest license plates.
(b) In addition to the regular fees for an original registration, renewal of registration, or transfer or substitution of the license plates, the following additional fees shall be paid for the issuance, renewal, retention, or transfer of the special interest license plates authorized pursuant to this section:
(1) For the original issuance of the plates, fifty dollars ($50).
(2) For a renewal of registration of the plates, or the retention of the plates if renewal is not required, forty dollars ($40).
(3) For transfer of the plates to another vehicle, fifteen dollars ($15).
(4) For each substitute replacement plate, thirty-five dollars ($35).
(5) In addition, for the issuance of an environmental license plate, as defined in Section 5103, the additional fees prescribed in Sections 5106 and 5108, which shall be deposited in the Environmental License Plate Fund.
(c) Except as provided in paragraph (5) of subdivision (b), all fees collected under this section shall, after deduction of the department’s costs in administering this section, be deposited in the Internet Educational Account, which is hereby created in the General Fund. The funds in the account shall be allocated by the Superintendent of Public Instruction to low-performing schools, to be designated on an annual basis using available statistical data, in a uniform amount per unit of average daily attendance, upon appropriation by the Legislature, to fund Internet educational programs.
(d) Any organization participating in the special interest license plate program pursuant to this section shall comply with all of the requirements imposed on participating organizations pursuant to Section 5060.
