An act to add Section 3000.05 to the Penal Code, relating to parole.

Existing law requires that a prison sentence include a period of parole, except as provided. Existing law also authorizes the Board of Prison Terms or the Department of Corrections to impose as a condition of parole that a prisoner make payments on outstanding restitution fines or orders, as specified.
This bill would authorize the Department of Corrections to contract with the Franchise Tax Board or a private debt collection agency for purposes of collecting restitution payments on behalf of victims.
The bill also would require the department to develop, by January 1, 1998, an implementation plan for the collection and disbursement of victim restitution orders that are imposed as a condition of parole.

The people of the State of California do enact as follows:


SECTION 1.

 Section 3000.05 is added to the Penal Code, to read:

3000.05.
 (a)  The Department of Corrections may contract with a private debt collection agency or with the Franchise Tax Board, whichever is more cost-effective, to make collections, on behalf of a victim, from parolees who have failed to make restitution payments according to the terms and conditions specified by the department.
(b)  If a debt is referred to a private collection agency or to the Franchise Tax Board pursuant to this section, the parolee shall be given notice of that fact, either by the department in writing to his or her address of record, or by his or her parole officer.

SEC. 2.

 By January 1, 1998, the Department of Corrections shall develop an implementation plan for the collection and disbursement of victim restitution orders that are imposed as a condition of parole. The plan shall include, but not be limited to, the use of the inmate restitution fine collection system data base available from the Correctional Management Information System.
