AB-431 California Environmental Quality Act: exemptions: projects in Town of Paradise and Butte County.(2019-2020)



SECTION 1.

 Section 21080.51 is added to the Public Resources Code, to read:

21080.51.
 (a) This division does not apply to projects or activities related to the provision of sewer treatment or water service to the Town of Paradise or projects or activities undertaken by the Paradise Irrigation District related to the provision of water service.
(b) This division does not apply to projects or activities undertaken by a public agency to improve evacuation routes, including maintenance, repair, expansion, or addition of new roadways, in the Town of Paradise.

SEC. 2.

 Section 21080.52 is added to the Public Resources Code, to read:

21080.52.
 This division does not apply to projects or activities undertaken in the County of Butte related to forest health and fuel reduction that involve thinning overgrown brushes or trees 10 inches or less in diameter by mechanical thinning, pile burning, prescribed fire, and grazing.
SEC. 3.
 The Legislature finds and declares that a special statute is necessary and that a general statute cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution because of the unique circumstances faced by the Town of Paradise, the Paradise Irrigation District, and the County of Butte.
SEC. 4.
 No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because a local agency or school district has the authority to levy service charges, fees, or assessments sufficient to pay for the program or level of service mandated by this act, within the meaning of Section 17556 of the Government Code.
