AB-345 Vehicular air pollution: regulations: exemption.(2017-2018)



SECTION 1.

 Section 43013.4 is added to the Health and Safety Code, to read:

43013.4.
 (a) As used in this section, the following definitions apply:
(1) “Agricultural vehicle” has the same meaning as in paragraph (6) of subdivision (m) of Section 2025 of Title 13 of the California Code of Regulations, as it read on January 1, 2017.
(2) “Low-mileage agricultural vehicle” means an agricultural vehicle that meets the requirements of subdivision (m) of Section 2025 of Title 13 of the California Code of Regulations, as it read on January 1, 2017.
(b) Beginning January 1, 2019, the state board shall exempt from any regulation to reduce emissions of diesel particulate matter, oxides of nitrogen, and other criteria air pollutants from in-use, diesel-fueled vehicles a vehicle that does not exceed 5,000 miles annually and has submitted to the state board the documentation required pursuant to paragraph (12) of subdivision (r) or subdivision (s) of Section 2025 of Title 13 of the California Code of Regulations, as it read on January 1, 2017.
(c) (1) Beginning January 1, 2019, and until January 1, 2023, the state board shall exempt from any regulation to reduce emissions of diesel particulate matter, oxides of nitrogen, and other criteria air pollutants from in-use, diesel-fueled vehicles a low-mileage agricultural vehicle if the owner of that vehicle has initially submitted by January 31, 2019, to the state board the documentation required pursuant to paragraph (14) of subdivision (r) or subdivision (s) of Section 2025 of Title 13 of the California Code of Regulations, as it read on January 1, 2017.
(2) The exemption provided for pursuant to paragraph (1) shall apply so long as the low-mileage agricultural vehicle satisfies the reporting requirements of paragraph (14) of subdivision (r) or subdivision (s) of Section 2025 of Title 13 of the California Code of Regulations, as it read on January 1, 2017, and meets the following:
(A) Does not exceed 15,000 miles between January 1, 2019, and January 1, 2020.
(B) Does not exceed 10,000 miles annually between January 1, 2020, and January 1, 2023.
(d) The state board shall amend any applicable regulation in effect as of January 1, 2019, to implement this section. Any rulemaking opened pursuant to this subdivision shall be limited to the purposes of this section.
